MOST IMPORTANTLY
● Leather is a natural product that can show scars, scratches and other irregularities. There can be slight variations in colour and grain even if you order two items of the same colour or type. Our colour description indicates the colour of the outer side of the product. The inner side does not necessarily conform with that description, nor with the colour you see in the pictures.
● The package is dispatched from Switzerland. Orders placed outside of Switzerland may incur additional VAT and custom fees which are the responsibility of the customer to pay. The resulting costs vary from country to country. Please check with your local customs authority for more information.
● You bear the full costs of a possible return. Shipping costs, custom fees and taxes will not be refunded. In case of an incorrect delivery, the total amount of the respective item(s) will be refunded.
1. GENERAL
These terms and conditions shall govern the sale by POWCH (named “we”) and the buyer (named “you”).
If you are unhappy with any aspect of our terms and conditions, contact us before placing an order. Any terms and conditions that you propose or object to are subject to our written consent.
By placing an order with us, we deem that you have read, understood and agreed to our Terms and Conditions.
We reserve the right to alter these Terms and Conditions at any time, without prior notice, at our sole discretion.
2. ORDERS AND CONCLUSION OF CONTRACT
We only accept orders placed via our website www.powch.ch
As soon as you have filled in the order form and confirmed your order with the "PURCHASE" button, a contract between you and us is established in accordance with these terms and conditions.
Once the payment process is completed, you cannot withdraw from your purchase.
you will then receive an order confirmation via email from us.
You acknowledge that the products ordered are for your private non-commercial use. Distributing the acquired products for a commercial purpose is prohibited.
3. PRICES AND PAYMENT CONDITIONS
Our prices are free of obligation. Any offer can be withdrawn, as long as there is no other written agreement.
All prices are indicated in Swiss Francs.
According to the Swiss value added tax law (Mehrwertsteuer-Gesetz) Art. 10, POWCH is not taxable for VAT.
We currently accept payments by the following credit / debit cards: Visa, MasterCard, American Express
The total cost of your items ordered, plus shipping fees as displayed in the order form, will be billed to your credit card.
If your credit card account is in a currency other than Swiss francs, your credit card provider may apply foreign exchange fees.
4. SHIPPING CONDITIONS, IMPORT DUTIES AND TAXES
All orders are sent by Swiss Post.
The items will be shipped at the indicated fee. The shipping fee depends on your country and will be displayed in the checkout process. For orders within Switzerland no shipping costs will apply.
Shipments to customers outside of Switzerland may be subject to import duties and taxes. By accepting these terms you confirm that you will bear all extra costs.
Delivery times are depending on the postal services of the country to which the order is sent; therefore, we are unable to guarantee delivery times. Unless we notify you otherwise, we do, however, guarantee the fastest possible handling of your order.
5. APPEARANCE AND CONDITION OF PRODUCTS
We have tried to display the colours and textures of our products accurately. However, the actual colours you see depend on your screen and may not be exact.

Our colour description indicates the colour of the outer side of the product. The inner side does not necessarily conform with that description, nor with the colour you see in the pictures.
The dimensions indicated on the product pages may also vary slightly from the actual dimensions of your product.
Any contents and additional objects used to present the products are not included and will not be shipped.
Both appearance (colour, texture) and dimensions (such as length, width) of your product may change slightly with use.
6. RETURNS
We check the quality of all our products before dispatch, therefore, you should not have any reason to return an order.
If, however, you would like to return goods because you have received the wrong product, the items are damaged, or you are, for other reasons, dissatisfied with the product, you may get in touch with us by email at ohno@powch.ch within seven days of receipt.
Include photographs of the respective product in your email, that illustrate your concern.
We will then respond to you and confirm the course of action that will be taken to resolve your concern. Do not return any goods without our prior written confirmation.
Items you would like to return must be sent back, including all packaging, and without any traces of use.
We will check all returned articles. Returns will be rejected, if
● the product shows signs of use
● the product is returned without the original packaging.
● the goods are damaged due to return transport
● you have not informed us prior to returning an order and if we have not confirmed the return

If the items get lost during the return shipping, POWCH will not refund the amount. We recommend sending the goods using a track & trace shipping service.
If we accept a return, we will send you a replacement item. Upon your written request, or if we are not able to deliver the item initially ordered, we will refund you the full cost of the respective product, excluding duties, taxes and shipping costs, within seven days of our receipt.
If you have received a wrong or damaged product, we will also refund the shipping costs of our shipment.
If you have ordered several items and only a part of your order is wrong or damaged, shipping costs will not be refunded.
7. WARRANTY
The lifespan of a product depends primarily on the manner of your use. We therefore cannot grant a general warranty.
In the case of a material defect in the product on our behalf or faulty manufacture, you can get in touch about the issue via email to ohno@powch.ch within 12 months from the purchase date.
If it is clear that the product presents a manufacturing fault you can, in consultation with us, decide on one of the following options:
- We repair the product
- You get a price reduction
- You choose a similar product in exchange
- You withdraw from the contract.
Please note that even in the case of manufacturing faults, we cannot accept returns or exchanges, past a 12 month period from the date of purchase.
Articles on discount are excluded from warranty.
8. DATA AND PAYMENT SECURITY
All data you submit in the checkout process and / or contact form is protected by TLS-Technology.
Our payment processor “Stripe” is PCI compliant. PCI-DSS (Payment Card Industry Data Security Standard) is a framework for developing a robust payment card data security process.
We guarantee not to pass on or sell our customers’ information.
9. PROTECTION OF INTELLECTUAL PROPERTY
POWCH is the sole owner of the design and content of this website, which is protected by copyright law. Any unauthorised modification, reproduction or copy is strictly forbidden.
10. LIABILITY
Our liability for damaged or lost goods is ruled by the provisions of Swiss law. We are only liable for gross negligence and intent, and only for the maximum worth of the transaction.
Binding law is not affected.
Should you choose to resell (prohibited according to paragraph 2) or alter our products, we deny responsibility for any damages and costs that may result to you or third parties. Furthermore, any claim for warranty expires if you take such action.
11. FINAL PROVISIONS
All terms and contracts under this agreement are governed by Swiss Law without regard to conflicting laws. UN purchasing law (CISG) is excluded. This does not apply to compulsory law of the country in which the customer has their residence.
The designated court is Zurich, Switzerland. However, we may appeal to courts in your country of residence.
The parties to the contract shall endeavour to settle any argument that may arise from the realisation of the contract in an amicable way and out of court.
